The protection of your personal data is a priority for Quantique Services. Below, we describe who we are, for what purposes we may use your personal data, how we process it, with whom we share it, how long we retain it, and also the ways to contact us and to exercise your rights.
Who are we?
Your data will be processed by Legado Viajante Unipessoal Limitada, registration number 516616862, (hereinafter referred to as Quantique Services).
Quantique Services is the data controller within the meaning of the General Data Protection Regulation (hereinafter referred to as GDPR).
Why do we process your information?
Your personal data may be collected and processed by Quantique Services for the following purposes:
a) For the fulfilment of legal obligations to which Quantique Services is subject, in particular communications to the foreign and border services and for billing purposes.
b) For the purpose of performance of the temporary accommodation contract for tourists or the Local Accommodation Management Contract entered into with Quantique Services, namely payment transactions, management of check-ins and check-outs, management of guests, charging a deposit, providing complementary services to the stay such as cleaning, transfers and breakfast or grocery services, management of contractual obligations or for pre-contractual diligence purposes.
c) For the purpose of mobile and email communications, with information and commercial communications, digital platforms, within the scope of Quantique Services’ marketing strategies, commercial and contractual information and communications, as well as for information requests.
d) For the purpose of protecting property or assets held by Quantique Services, as well as for statistical analysis purposes.
The non-supply of personal data for the purposes provided for in points (a) and (b) leads to non-compliance with legal obligations by Quantique Services and, consequently, the possibility of termination of the temporary accommodation contract for tourists or the Local Accommodation Management Contract entered into, without the right to any compensation, as well as deficient services provided by Quantique Services that cannot be attributed to it.
What kind of personal data do we collect?
Within the scope of its activity, Quantique Services will collect and process the personal data necessary to provide the contracted services, respond to information requests or for pre-contractual management, namely identification data, contact details, bank or payment card data.
For what purposes do we process your information?
The processing of your personal data will be carried out on the basis of the performance of the temporary accommodation contract for tourists, the Local Accommodation Management Contract and the fulfilment of legal obligations imposed on Quantique Services, in particular by legislation regarding the entry, stay and departure of foreigners in national territory and tax legislation (Article 6(1)(b) and (c) of the GDPR).
Additionally, the personal data collected for the purposes provided for in point (c) of the previous section are based on the consent you have given to Quantique Services for their processing (Article 6(1)(a) of the GDPR).
For the purposes provided for in point (d) of the previous section, XXXXX shall process personal data based on the legitimate interest it pursues (Article 6(1)(f) of the GDPR).
How long do we retain your information?
Without prejudice to legal provisions, regulatory requirements or judicial determinations to the contrary, the personal data collected will be retained only for the minimum period necessary for the purposes that motivated their collection or subsequent processing.
Who may we share your personal data with?
Quantique Services may need to share some of your personal data with other recipients. These recipients include:
a) Organizations and/or companies affiliated with Quantique Services, provided they respect an equivalent personal data protection policy.
b) Public entities to which Quantique Services is legally obliged to provide information, namely the Foreign and Border Services and the DGCI – Directorate-General for Taxes.
c) Subcontractors providing certain services related to your personal data, under a subcontract and solely for the purpose of providing technical assistance to Quantique Services. These include, in particular, website hosting providers, email marketing service providers, cleaning companies, law firms, accounting firms and insurance companies.
d) Competent authorities to which Quantique Services is legally obliged to disclose information in the context of judicial proceedings or to detect technical and/or security issues, such as judicial entities or competent supervisory authorities.
Are my data transferred to countries outside the European Union?
Your personal data, collected by Quantique Services, will not be transferred to any entity established outside the territory of the European Union.
Exceptionally and subject to certain conditions, Quantique Services may transfer your personal data to countries outside the territory of the European Union, in accordance with applicable legislation, namely for data hosting or storage purposes, subcontracting of technical processing, backup and recovery of hosted data, and service development.
Quantique Services ensures that it will not transfer your personal data to countries that do not guarantee an adequate level of protection, in accordance with the provisions of the GDPR.
What are my rights?
At any time, in accordance with the GDPR, you may request access to your personal data, as well as its rectification or erasure, restriction of processing, the right to object and the right to data portability.
If the requests submitted are manifestly unfounded or excessive, in particular due to their repetitive nature, Quantique Services may require the payment of a reasonable fee taking into account the administrative costs of providing the information or communication, or taking the requested measures, or refuse to act on the request.
In the case of personal data whose processing by Quantique Services is based on the consent you have given, you have the right to withdraw your consent, without such withdrawal affecting the lawfulness of the processing carried out based on the consent previously given, nor the subsequent processing of the same data based on another legal basis, such as the performance of a contract or compliance with a legal obligation to which Quantique Services is subject.
You also have the right to lodge a complaint with the National Data Protection Commission.
Security and confidentiality
We are committed to keeping your data secure and we use appropriate security measures to ensure that your personal data are protected and to prevent access by unauthorized persons. However, the transmission of data over the Internet is not completely secure and we cannot provide an absolute guarantee of the security of the information transmitted through our website.
We also respect the confidentiality of your information. Therefore, we do not sell, distribute or otherwise make your information commercially available to any third party. Quantique Services undertakes to keep your information confidential in accordance with this Privacy Policy and applicable legislation.
